8x Dialer Customer Terms

Version: 2026-10-22

1. Who these terms are between

These terms are an agreement between 8x Social, Inc., a Delaware corporation whose registered address is 1111B S Governors Ave STE 47647, Dover, DE 19904, United States ("8x", "we", "us"), which sells the 8x Dialer, and the business that signs up for it ("you", the "client").

The person who accepts these terms confirms that they may bind the business. The 8x Dialer is sold to businesses for business use only, never to consumers.

2. The documents that make up the agreement

These terms, and the documents below, are the whole agreement between you and 8x for the 8x Dialer:

Where they differ, the Data Processing Agreement governs personal data, the Acceptable Use Policy governs how you call, and these terms govern everything else.

3. The 8x Dialer

The 8x Dialer is 8x's calling software for a business that runs its own sales reps: a dialer with phone numbers 8x provides, call recording and transcription, AI features (such as call summaries, call scoring, a live coach, practice calls and a generated playbook), lead lists, booking and a team floor. 8x may add, change or remove features.

AI features. AI features help your people; they can be wrong, and you are responsible for the decisions you make with them. AI features may be rate-limited or capped, and may be unavailable at times.

Emergency calls. The 8x Dialer cannot place emergency calls, such as calls to 911.

4. Approval before your first call

You may not place a call until 8x approves your business.

  1. You apply. You give 8x your business details, your named representative, your website, your use case, the countries you want to call, and the attestations the application asks for, including that you have a lawful basis to call your leads.
  2. You authorise 8x to file those details with its telephony provider and the carriers, as your calling identity, and to register you for access to the US National Do Not Call Registry. 8x files them once you submit your application.
  3. 8x reviews your application and approves it, asks for changes, or declines it. A decline is final and closes your account.
  4. After approval, your legal name, registration number, address, named representative, website and use case are locked. A change is a request that 8x reviews again; you keep calling on the approved details meanwhile. Each new calling country is a request that 8x approves.

5. Your calls

You initiate every call. You choose the leads, the campaigns and the people who dial, and a person at your business starts every dialing session. You place every call, for your own business.

You are responsible for your calls, and for following every law that applies to them, including telemarketing, do-not-call, call recording, privacy and electronic-marketing laws, wherever the person you call is.

The guards are facts, not legal cover. The 8x Dialer limits calling to business hours in the prospect's time zone, never calls a number on your do-not-contact list or 8x's, screens US numbers against the National Do Not Call Registry, caps abandoned calls, and keeps a campaign from calling until its script carries the recording notice. These guards help you call properly; they do not make your calls lawful, and you may not rely on them to do so.

Phone numbers stay 8x's. You call only from numbers 8x provides, and 8x may release, replace or rest a number.

6. Your people and your account

Your people are Owners, Managers and Reps. You are responsible for everyone who uses your account and for everything done under it. Everyone who dials for you accepts the 8x Dialer Conduct Agreement first. Keep sign-in details safe and tell 8x at once at support@8x.social if you think someone has misused your account.

7. Your data

You own your data: your leads, your calls, their recordings and transcripts, your notes and outcomes, your playbook and your uploads ("your data"). You give 8x the right to host, copy, process and display your data to provide the 8x Dialer to you and as these terms describe.

You have the right to it. You import and use only leads you have the right to call, with a lawful basis, and only data you have the right to give 8x.

Personal data. 8x processes the personal data in your data for you, under the 8x Dialer Data Processing Agreement.

8. How 8x uses your data

  1. To provide the 8x Dialer: placing and recording your calls, transcribing them, running the AI features for you, keeping your history, and supporting you.
  2. Who joined your meetings. 8x reads who joined the meetings it books into your calendar, to confirm they were held. It reads who joined the meetings in a host's own calendar only once that host has agreed to this, in those words, when connecting their Google Calendar. 8x does the same for the meetings it books on its own calendar, for example for a host who has not connected one. 8x never reads a meeting it did not book. From the meetings it books it reads only who joined: it never records them, and never reads their recording, transcript or chat from Google.
  3. Review for quality and compliance. 8x may open any of your calls, with its recording, transcript and flags, to review it for quality and compliance, without asking you first.
  4. Review to provide, evaluate and improve the 8x Dialer. 8x reviews content, such as calls and transcripts, to provide, evaluate and improve the 8x Dialer. 8x reads it where it is stored: it never copies your content into another client's output, or into prompts or examples shared between clients.
  5. 8x never trains AI models on your data.
  6. To run the 8x Dialer safely: watching calling signals, answering complaints and tracebacks, billing you, keeping records the law requires, and protecting the 8x Dialer and the people it calls.

9. Fees and credits

Seats. You pay for each Calling seat monthly, in advance, at the price shown when you buy. There is no commitment and no trial; the plan renews each month on the day of your first payment (the renewal date) until it ends. Prices exclude taxes; you pay any taxes due on them.

Credits. Calls, extra phone numbers, practice calls past the practice allowance and other services are paid in credits, at the rates the 8x Dialer shows. A credit is worth $0.01.

  • Included credits. Each seat includes 20,000 credits a month, pooled across your business and spent before bought credits. They reset at each renewal and are never rolled over or refunded. Seats added during a month add their included credits pro rata.
  • Credit packs. Only Owners buy credit packs. Bought credits never expire. They are refunded only when 8x closes your account for its own reasons and not for anything you did (a no-fault close): then 8x refunds your unused bought credits to your card. Included credits and credits added by 8x are never refunded.
  • Credit left. A new call starts only while you have credit left to cover it. A call that has connected runs to its end, even if it takes your credit left below zero; your next purchase pays that first.

Your card. You authorise 8x, through its payment processor, to charge the card you save for each renewal and for each purchase you make. Invoices go to your billing email.

Automatic top-up. Automatic top-up buys credits for you when your credit left runs low. It is off unless an Owner switches it on, when making your first payment or at any time after. The Owner chooses:

  • a pack: 5,000, 10,000, 25,000 or 50,000 credits;
  • a threshold: a number of credits; and
  • a monthly ceiling: the most credits automatic top-up may buy in each month of your plan, from one renewal date to the next.

By switching it on, you authorise 8x, through its payment processor, to charge your saved card for the pack's price, plus any tax due, without asking you each time, whenever a charge takes your credit left from the threshold or above to below it, as long as the pack keeps that month's automatic top-ups within the ceiling. Each top-up is a purchase of bought credits, with its own invoice, under the rules above. 8x does not top up while your plan is Paused or your account is suspended, after your plan has ended, or when the pack would take your bought credits past the most 8x lets a client hold.

Any Owner can switch automatic top-up off at any time. It also switches off at once if your card is declined or your bank asks you to confirm a payment, and it switches back on with your next successful payment.

Each time an Owner switches automatic top-up on, or changes its pack, threshold or ceiling, 8x records their consent: the Owner, when, the pack, threshold and ceiling they chose, and the version of these terms they saw. Switching it off records who did it and when.

If a renewal payment fails, your plan is Past due: everything keeps working for 2 days. If it is still unpaid, your plan is Paused: calling stops, and Owners can still pay, see the plan and export your data. Paying makes the plan Active again, with a new month from that day. While you are Paused, 8x may release your phone numbers. 8x never deletes a client for being Paused for 12 months; after 12 months Paused, 8x gives your Owners 30 days' notice and then deletes your data as section 12 describes.

Payment disputes. If any of your payments is disputed, or flagged to 8x as possibly fraudulent, 8x suspends your account at once and removes the credits of the disputed pack until 8x has reviewed it. Your credit left may go below zero as a result.

Ending your plan. An Owner can end the plan at any time. It runs to the renewal date and then closes; the month already paid is not refunded.

10. Warn, throttle, suspend and close

8x watches signals of how your calls are going (for example, how often people ask not to be called again) and acts on them in four steps:

  1. Warn. 8x emails your Owners and Managers which signal is over its limit and what to fix. Nothing stops.
  2. Throttle. Every rep at your business dials one line at a time until the signal is back under its warning limit.
  3. Suspend. Calling stops: a call already connected runs to its end, and no new call is placed. Your leads, call review, playbook and export stay usable. 8x suspends automatically when 12% or more of your connected calls end in Do not call (counted once you have 100 connected calls), when 8x's telephony provider acts against your traffic, or on a payment dispute (section 9); otherwise an 8x admin decides. Only 8x reinstates.
  4. Close. 8x may close your account for a breach of these terms or the Acceptable Use Policy. A close is decided by a person at 8x and is final. A close for a breach refunds nothing, the month's seats included, and 8x writes off any credit left below zero.

8x may also suspend or close your account at once if it reasonably believes it must, to protect the people you call, its telephony provider's accounts or other clients, or to obey the law.

11. Complaints and tracebacks

When someone complains about a call you made, or a carrier or authority traces one back, you answer 8x within one business day with what 8x asks for. 8x answers tracebacks about your calls itself and may share your calling records to do so. Complaints reach 8x at abuse@8x.social.

12. When your account closes

Your account closes when your plan ends, when 8x declines or closes it, or when you ask.

  • For 14 days after it closes, your account is read-only and your Owners can export your data. Within those 14 days you can restart the plan and keep everything, unless 8x closed it for abuse.
  • Then 8x deletes your data, or at once if you ask.
  • What 8x keeps. 8x keeps a closure record (your application and its approval, closures, complaints and tracebacks, your do-not-contact list, erasure records and audit logs) and the dial record of every call for 4 years after deletion, and billing records for 7 years. The 8x Dialer Data Processing Agreement describes them.

13. 8x's property

8x owns the 8x Dialer and everything 8x provides with it, apart from your data. You may use it only for your own business while your account is open. You may not copy, resell, reverse-engineer or probe it, give anyone outside your business access to it, or use it to build a competing product. If you send 8x feedback, 8x may use it freely.

14. Disclaimers

TO THE EXTENT THE LAW ALLOWS, THE 8x DIALER IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. 8x DOES NOT PROMISE THAT THE 8x DIALER WILL BE UNINTERRUPTED OR ERROR-FREE, THAT AN AI OUTPUT IS ACCURATE, THAT A CALL WILL CONNECT OR A NUMBER WILL NOT BE LABELLED BY A CARRIER, OR THAT YOU WILL BOOK MEETINGS OR WIN BUSINESS.

15. Limitation of liability

TO THE EXTENT THE LAW ALLOWS:

  1. NEITHER 8x NOR ITS OFFICERS, EMPLOYEES OR SUPPLIERS IS LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL OR DATA, EVEN IF TOLD THEY WERE POSSIBLE.
  2. 8x'S TOTAL LIABILITY UNDER THIS AGREEMENT IS LIMITED TO THE AMOUNT YOU PAID 8x IN THE 12 MONTHS BEFORE THE EVENT THAT GAVE RISE TO THE CLAIM.

These limits do not apply to liability the law does not allow to be limited, such as for fraud.

16. Your indemnity

You will defend 8x against, and pay for, any third-party claim, fine or cost (including reasonable legal fees) that arises from your calls, your data, your people, or your breach of this agreement or of any law, including telemarketing, do-not-call, call recording and privacy laws.

17. Changes to these terms

8x may change these terms. Before a material change takes effect, 8x tells your Owners by email or in the 8x Dialer, and Owners may be asked to accept the new version. Using the 8x Dialer after the change takes effect means you accept it. If you do not, end your plan. The version date is at the top.

18. General

  • Governing law. Delaware law governs this agreement, without regard to its conflict-of-laws rules. The courts in New Castle County, Delaware, decide any dispute about it, and both of us accept their jurisdiction.
  • Assignment. You may not transfer this agreement without 8x's written consent. 8x may transfer it to an affiliate or a buyer of its business.
  • Severability and waiver. If a part of this agreement cannot be enforced, the rest stands. Not enforcing a part is not a waiver of it.
  • Force majeure. 8x is not liable for a delay or failure caused by events outside its reasonable control, including outages of carriers or of 8x's providers.
  • Notices. 8x sends notices to your Owners' email addresses or in the 8x Dialer. You send notices to legal@8x.social.
